Terms & Conditions

Please read these Terms and Conditions carefully before using FibDefense ("the App"), operated by FibDefense ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. License Grant
Subject to your compliance with these Terms, FibDefense grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use FibDefense on Apple devices that you own or control, solely for your personal, non-commercial purposes.
This license is subject to and does not supersede the Apple App Store Terms of Service. Apple is not a party to these Terms and has no obligation to provide support or warranty for the App.
2. In-App Purchases
FibDefense offers an optional premium content unlock (com.fibdefense.app.unlock) available as a one-time purchase. All in-app purchases are processed entirely by Apple's App Store payment system.
All sales are final in accordance with Apple's App Store policies. FibDefense does not process or control refunds. If you believe you are entitled to a refund, please contact Apple directly through their standard refund request process.
The premium unlock is a one-time purchase that unlocks content for the lifetime of the app on your Apple account. FibDefense reserves the right to modify, add to, or remove premium content features with reasonable notice.
3. Intellectual Property
All content in FibDefense — including but not limited to graphics, sprites, user interface design, audio, game logic, code, and trade dress — is the exclusive intellectual property of FibDefense and is protected by applicable copyright, trademark, and other intellectual property laws.
The Fibonacci sequence and Zeckendorf's theorem are mathematical concepts in the public domain. However, FibDefense's specific implementation, game mechanics, visual representation, and creative expression of these concepts within FibDefense are proprietary and protected.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content from FibDefense without prior written consent from FibDefense.
4. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
FibDefense does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. You use the App at your sole risk.
5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FIBDEFENSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.
FibDefense's total liability to you for any claim arising out of or relating to these Terms or the App shall not exceed the amount you paid to FibDefense for the App or its in-app content in the twelve (12) months preceding the claim.
6. Prohibited Uses
You agree not to:
- — Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
- — Modify, adapt, translate, or create derivative works based on the App
- — Remove, alter, or obscure any proprietary notices in the App
- — Use the App for any commercial purpose without written consent
- — Use cheats, exploits, automation software, or any unauthorized third-party tools
7. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law provisions.
Any disputes arising out of or related to these Terms or the App shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of New Mexico, and you consent to the personal jurisdiction of such courts.
8. Changes to These Terms
FibDefense reserves the right to modify these Terms at any time. Updated Terms will be posted on this page with a new effective date and communicated via App Store release notes where material changes are made. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.
